Dr Janez Pogorelec

 

 

Janez Pogorelec was born in Novo mesto on 19 February 1962. He studied at the Faculty of Law at the University of Ljubljana, and graduated in 1987. In 2000 he obtained his masters degree and, in 2005 the title of Doctor of Legal Sciences from the same faculty.

 

After passing the bar examination, he was employed in 1990 by the Government Office for Legislation, i.e., the then State Secretariat for Legislation, where he was gradually promoted to state undersecretary and head of the Section for Constitutional Order. In 2004 he was appointed deputy director of the Government Office for Legislation. On 15 December 2005 he was appointed acting director of the Office, and on 26 April 2006 Director of the Government Office for Legislation. He has been a member of the State Electoral Commission since 1992. He has also been a member of a number of government commissions, such as the Commission for National Communities and the Commission for Religious Communities, he was also head of the expert group preparing constitutional changes that the Government submitted to the National Assembly. He worked on the preparation and revision of many laws and in the legal revision of EU acts, specifically contributing to the Slovenian translation of the EU Constitution. He took part in twinning projects in Macedonia and Serbia. He has published a series of expert articles in various magazines, primarily in ‘Pravna praksa’ (Legal Practice). As a speaker, he regularly attends the conference ‘Dnevi javnega prava’ (Public Law Days) and other expert meetings. He also worked extensively on the computerisation of work related to legal proceedings.

Main Areas of Activity and Programme Priorities

The Government Office for Legislation ensures constitutionality and legality, the coherence of the legal system, the conformity with legal drafting rules applicable to laws and other regulations of the RS.

 

The work of the Government Office for Legislation is organized in the following divisions:

 

  • Division for the Constitutional System and Public International Law
  • Division for European Affairs and Computerisation of Legislative Procedures
  • Justice and Home Affairs Division
  • Economic System Division
  • Public Finance and the Financial System Division
  • Agriculture, Environment and Spatial Planning Division
  • Non-Commercial Activities Division
  • General Affairs Service

 

The Office performs the following tasks:

  • It examines whether draft acts and other legislation submitted to the National Assembly by the Government, or presented by the National Assembly to be reviewed by the Government, draft legal acts by the Government, and by ministers, are consistent with the Constitution, legislation, and the EU acquis and whether they are in keeping with the rules of legal practise.
  • Following Government decisions, it prepares draft acts and other regulatory documents.
  • It deals with issues related to the development of the legal system. In cooperation with the Government and line ministries, it is responsible for the implementation of Constitutional provisions and legality.
  • Following decisions of the Government or the Prime Minister, it draws up reports, positions and legal opinions on individual legal issues related to Government activities.
  • It undertakes comparative legal studies in relation to other countries and international organisations.
  • It devises the rules of legal practise to be used in the preparation of draft acts and other regulatory documents that the Government submits to the National Assembly, as well as of legal acts of the Government and ministers.
  • It carries out special tasks commissioned by the Government and related to the maintenance of constitutionality and the legality of regulations issued by ministers.
  • It monitors and examines the influence of the EU acquis on the national legislation as well as issues relating to the implementation of the EU acquis. It then provides opinions and proposals to the Government and ministries.
  • It gives notification of national regulations that have been adopted to assure the transposition of EU directives into the legislation of the RS, then makes progress reports to the Government.
  • It coordinates infringement proceedings initiated due to non-notification and prepares positions with line ministries.
  • It monitors the implementation of the Government’s programme of work with regard to the EU acquis.
  • It participates in the Government’s work with the National Assembly.
  • In accordance with the law, it issues the Official Gazette of the RS.
  • It administers, manages and coordinates the Legal information system of the RS.
  • It ensures that Government regulations and the regulations of ministries are published in the Official Gazette of the RS.
  • It carries out all other tasks in accordance with legislation.

  • Cooperation on the organisation and realisation of the Legislative Drafting Workshop.
  • Cooperation on the development of the Legal information system of the RS.
  • Cooperation on the project IT Support for Legislative Procedures in Ministries and the Government.
