Director

Ksenija Mihovar Globokar

Ksenija Mihovar Globokar was born on 17 August 1959 in Ljubljana. She studied at the Faculty of Law at the University of Ljubljana, where she graduated in 1983, whilst in 1986 she passed the national bar examination. After 1983, when she was first employed by the then Republic Committee for Legislation, she had demanding responsibilities in the legislative area. In 1987 she became a senior administrative worker in the area of non-commercial activities, taking on important responsibilities, in particular in the field of education and research. In 1993, she became an adviser to the Government and then in 1996 a State Undersecretary in the area of non-commercial activities. In 1999, she was appointed a Deputy Director of the Government Office for Legislation and became the Director of the Office on 13 February 2003. In 2006, she again became a Deputy Director. On 26 April 2011 she was appointed as a Director of the Government Office for Legilsation.

dr. Janez Pogorelec

Dr Janez Pogorelec

Dr Janez Pogorelec was born on 19 February 1962 in Novo mesto. He studied at the Faculty of Law in Ljubljana and graduated in 1987. In 2000, he completed his master’s studies and then in 2005 obtained a PhD in law. After passing the national bar exam, he in 1990 obtained employment at the Government Office for Legislation (or the Republic Secretariat for Legislation as it was called then), where he was gradually promoted to State Undersecretary and the Head of the Division for the constitutional system. In 2004, he was appointed a Deputy Director of the Government Office for Legislation. On 15 December 2005, he became the Acting Director of the Office and then on 26 April 2006, the Director. From 1992 to 2008 he was a member of the National Electoral Commission. Furthermore, he has been a member of a number of government commissions, from the commission for nationalities to that for religious communities; he headed the expert group for the drafting of constitutional changes proposed by the government to the National Assembly. He has also participated in the drafting and revising of a number of laws and in the legal revision of EU instruments, particularly in relation to the Slovenian translation of the European Constitution. In addition, he took part in twinning projects in Macedonia and Serbia. Dr Pogorelec has published a number of articles in various specialist reviews, in particular Pravna praksa. He regularly delivers lectures at the Days of public law and other professional gatherings. He has dedicated a considerable amount of time to working on the informatisation of the working processes relating to legislative procedures.

 

 

Deputy director

Mateja Tamara Fajs

Mateja Tamara Fajs was born on 27 May 1968 in Ljubljana. She studied at the Faculty of Law in Ljubljana and graduated in 1992. After passing the national bar examination she was employed in 1994 by the then Ministry of the Environment and Spatial Planning, where she had demanding responsibilities relating to the drafting of legislation pertaining to spatial planning and construction. Between 1997 and 1999 she worked as an advisor to the Government in the Office of the Prime Minister, where she was in charge of the implementation of a project relating to an active spatial planning and land policy, and of coordination of legislation regarding real-estate and spatial planning upon Slovenia’s accession to the EU. In 1999, she was appointed a Deputy Director of the Government Office for Legislation. Between December 2004 and January 2006, she held the position of the Secretary-General of the Government. Since 20 January 2006, she has again been performing the duties of a Deputy Director of the Office.

Main Areas of Activity and Programme Priorities

The Government Office for Legislation ensures constitutionality and legality, the coherence of the legal system, the conformity with legal drafting rules applicable to laws and other regulations of the RS.

 

The work of the Government Office for Legislation is organized in the following divisions:

 

  • Division for the Constitutional System and Public International Law
  • Division for European Affairs and Computerisation of Legislative Procedures

  • Public Finance and the Financial System Division
  • Agriculture, Environment and Spatial Planning Division

The Office performs the following tasks:

  • It examines whether draft acts and other legislation submitted to the National Assembly by the Government, or presented by the National Assembly to be reviewed by the Government, draft legal acts by the Government, and by ministers, are consistent with the Constitution, legislation, and the EU acquis and whether they are in keeping with the rules of legal practise.
  • Following Government decisions, it prepares draft acts and other regulatory documents.
  • It deals with issues related to the development of the legal system. In cooperation with the Government and line ministries, it is responsible for the implementation of Constitutional provisions and legality.
  • Following decisions of the Government or the Prime Minister, it draws up reports, positions and legal opinions on individual legal issues related to Government activities.
  • It undertakes comparative legal studies in relation to other countries and international organisations.
  • It devises the rules of legal practise to be used in the preparation of draft acts and other regulatory documents that the Government submits to the National Assembly, as well as of legal acts of the Government and ministers.
  • It carries out special tasks commissioned by the Government and related to the maintenance of constitutionality and the legality of regulations issued by ministers.
  • It monitors and examines the influence of the EU acquis on the national legislation as well as issues relating to the implementation of the EU acquis. It then provides opinions and proposals to the Government and ministries.
  • It gives notification of national regulations that have been adopted to assure the transposition of EU directives into the legislation of the RS, then makes progress reports to the Government.
  • It coordinates infringement proceedings initiated due to non-notification and prepares positions with line ministries.
  • It monitors the implementation of the Government’s programme of work with regard to the EU acquis.
  • It participates in the Government’s work with the National Assembly.
  • In accordance with the law, it issues the Official Gazette of the RS.
  • It administers, manages and coordinates the Legal information system of the RS.
  • It ensures that Government regulations and the regulations of ministries are published in the Official Gazette of the RS.
  • It carries out all other tasks in accordance with legislation.
