Aleš Zalar

 

Aleš Zalar was born on 22 October 1961. He graduated in law. From 1989 to 2008 he was a judge. At the end of his career as a judge he was a Senior District Court Judge. From 1991 to 2007 he was the President of the Basic Court in Ljubljana and later the District Court in Ljubljana. He was then the EU's legal consultant for EU law with the Romanian Supreme Court and for mediation with the Croatian Ministry of Justice. As a representative of the Council of Europe, the European Commission, the UN, the development agency USAID and the World Bank he has advised the governments of 14 European countries on judicial systems and efficiency policies, independence and responsibility in the judicial system, the fight against corruption and alternative dispute settlement.

 

In November 2007 he received the medal of the Slovenian Supreme Court for his outstanding work achievements, while in 2006 he was presented with a recognition by the Netherlands for the development of mediation in Slovenia and Europe. In 2004 he was named an honorary member of the Kentucky Bar Association. During his presidency, the District Court of Ljubljana received a special recognition from the Council of Europe and the European Commission for the programme aimed at clearing the court backlog with mediation and accelerated legal proceedings.

 

He is a founding member of the International Association for Court Administration, a member of administrative boards of the European Grouping of the Magistrates for the Mediation and, until 2008, a member of the Consultative Council of European Judges, a consultative body of the Committee of Ministers at the Council of Europe.

Boštjan Škrlec was born in Brežice on 23 March 1971. After graduating from the secondary school for mathematical and natural sciences, he enrolled at the Faculty of Law in Ljubljana in 1989, obtaining his degree in 1994. The same year after he completed his studies, he was employed as legal trainee with the former Basic Court of Novo mesto, Unit in Novo mesto. He concluded his traineeship by successfully passing the bar exam on 29 May 1996. His next job was with the District Court of Krško, where he performed the duties of legal assistant and temporarily also acted in place of the Court Secretary until 23 April 1999. 

 

He then became assistant to the district state prosecutor at the District State Prosecutor’s Office in Krško, and in January 2005, he was promoted to the post of district state prosecutor.

In December 2005, he was transferred to the Office of the State Prosecutor General of the Republic of Slovenia to perform more demanding duties and remained there until he was appointed State Secretary.

 

In addition to performing his regular state prosecutor duties, he has also cooperated in the international area since the time he was appointed assistant. He participated in several training programmes at home and abroad (particularly in the area of international cooperation), among which the following should be emphasized: two-part training within the programme "Training of Judges in European Community Law", organised by EIPA (European Institute of Public Administration) under the auspices of PHARE; a fourteen-day training course in the criminal law of the Federal Republic of Germany, organised by the Deutsche Stiftung fuer Internationale Rechtliche Zusammenarbeit; and a three-week study visit to the USA under the working title of "Combating International Crime", under the auspices of the State Department.

 

He has been a member of several delegations that represented the Republic of Slovenia at working meetings with the aim of implementing international cooperation in criminal matters. A particular emphasis in this context should be put on the project “Programme against corruption and organised crime in South-Eastern Europe” (PACO) within the Council of Europe. As an expert of the Council of Europe, he elaborated a conformity analysis of the criminal legislation of Serbia with the Cybercrime Convention jointly with Prof. Mark Gercke (Germany) in 2007.

 

During Slovenia’s Presidency of the EU Council, he was transferred to the Ministry of Justice, where he headed the COPEN Working Group and partially also the DROIPEN Working Group.

 

Currently he is also a member of the Moneyval Committee of the Council of Europe and has been participating as a legal expert in evaluating systems for the prevention of money laundering and financing of terrorism in the Republic of Montenegro. From June 2005 until his appointment as State Secretary, he was also president of the State Prosecutors’ Association of Slovenia.

Main Areas of Activity

The Ministry of Justice performs tasks relating to legislation in the fields of criminal law, general offences law, property law, contract law, and law of succession; to legislation on judicial procedures; organisation of legislation in the field of the judiciary, public prosecutors, state attorneys, lawyers, notaries public and implementation of penal sanctions; systemic organisation and coordination of denationalisation procedures; preparation of proposals and drafts for international agreements on cooperation in the field of criminal and civil law; financing and provision of human, technical and spatial resources for the activities of judicial bodies; continuous training of judges, state prosecutors, state attorneys as well as of other court personnel; international legal aid; amnesty and pardons; supervision over the work of judicial bodies; judicial statistics; information law; redressing of injustices and national reconciliation.

The Prison Administration performs administrative and professional tasks related to implementation of penal sanctions; organisation and management of prisons and correctional institutions; provision of financial, material, human, technical and other resources for the functioning of prisons and corrective institutions; training of personnel to meet the requirements of the implementation of penal sanctions and the exercise of prisoners’ rights and discharge of their duties.
