Katarina Kresal

 

Katarina Kresal was born on 28 January 1973. She graduated from the Faculty of Law cum laude in 1996 and passed the bar examination in 1999. After graduation she first worked as trainee clerk at the Higher Court of Ljubljana and then as a senior clerk in the Commercial Disputes Department of the Ljubljana District Court.

 

In 2000 she became independent legal consultant for commercial and corporate law at Kapitalska družba d.d. Ljubljana. In 2001 she became head of the legal department at Western Wireless International. From 2003 she worked for Miro Senica Attorneys at Law, first as candidate attorney and then an attorney and was head of the commercial and international law department and deputy head of the office from 2005. She has published articles in international law journals and participated at several international conferences.

 

After being elected leader of the Liberal Democracy of Slovenia (LDS) in June 2007 she became employed by the LDS. She was elected an MP at the 2008 elections and Minister of the Interior on 21 November 2008.

Damjan Lah, MSc

Damjan Lah was appointed Secretary General of the Ministry of the Interior on 26 March 2009, having been Acting Director General since 4 December 2008. Prior to that, he was Head of the Legal, Personnel and General Tasks Service and Deputy Director of the Agency of the Republic of Slovenia for Public Legal Records and Related Services, Secretary General of the Ministry of Finance, State Secretary at the Ministry of Labour, Family and Social Affairs and Director of the Administrative Office of the Prime Minister.

Mr Lah has specialist expertise and experience in managerial work, in particular leadership and organizational skills in the field of public administration, direct management, human resources management and financial management. His other areas of knowledge include change management, organizational transformation, team formation and leadership, higher-education and scientific research legislation as well as the European Union's higher-education policy, legislation and protection against natural and other disasters, and also defence.

As a body within the Ministry, the police force is one of the pillars of national security, ensuring a high degree of internal security for all inhabitants of Slovenia, by protecting the constitutional order and democratic political system as well as other constitutional values. The functioning of the Police is founded on the exercising and respect of the legal order, European conventions and recommendations, plus an ethical and professional approach alongside consistent respect of human rights and fundamental freedoms.

 

Police duties include protecting the life, personal safety and property of individuals, prevention and investigation of criminal offences and violations, detection and arrest of perpetrators of criminal offences and violations, and of other wanted persons and their remand to the competent authorities; maintenance of public order; supervision and regulation of traffic on public and unregistered roads available for public use; protection of national borders and control of border crossings; carrying out duties laid down in the regulations on aliens; protection of certain individuals, bodies, structures and locations, and protecting the secrecy of data of state bodies.

 

Police organisation

 

In accordance with the law, the Police is organised to perform duties on the national, regional and local levels. Duties are performed by the general police administration, police administration units and police stations. Police tasks at the regional level fall within the jurisdiction of individual police administration units, and those at local level within the jurisdiction of the police stations.

 

  • The General Police Administration, headed by the Director-General of the Police, adopts guidelines, determines strategy and monitors the performance of police duties.
  • The police administration units are headed by directors, who report to the Director-General of the Police.
  • Police stations perform duties relating to general and transport safety, and to border security. Police stations are headed by Commanders, who report to the director of the relevant police administration.

The Internal Affairs Inspectorate performs the tasks of inspection supervision of the implementation of regulations in the fields of private protection, detection activities, weapons, ammunition, explosives and administrative affairs relating to transportation.

 

Established by Government decree on 1 January 2004, it began formal operations on 15 February 2004. The Inspectorate is a body within the Ministry of the Interior, and performs tasks in the following areas:

  • overseeing implementation of regulations in the area of private protection and detective work;
  • overseeing implementation of regulations in the area of weapons and ammunition;
  • overseeing implementation of regulations in the area of roadworthiness inspections of motor vehicles;
  • overseeing implementation of regulations in the area of the system of public servants;
  • administrative inspection.

 

 

Main Areas of Activity

The mission of the Ministry is to provide the highest possible level of security in the state, which is attained through preventive rather than repressive action of the law enforcement agencies. Aiming to implement both tasks, the Ministry of the Interior is responsible for public security and police, internal administrative affairs and migrations, pursuant to the State Administration Act.

The Ministry of the Interior, together with the Police and Internal Affairs Inspectorate as autonomous bodies within its framework, performs tasks defined by law in the following fields of activity:

  • internal administrative affairs;
  • tasks in the field of migration and integration
  • police and security;
  • the Police;
  • the Inspectorate for Interior Affairs of the RS.
      

The Ministry is also responsible for the coordination of European affairs and international cooperation in the field of security.

 

Internal administrative affairs

The Internal Administrative Affairs Directorate performs duties in the following areas:

 

  • enforces laws, regulations and general acts in the area of internal administrative affairs and migration;
  • implements policies in the area of internal administrative affairs;
  • monitors the situation in the area of internal administrative affairs, identifying relevant trends and new occurrences and taking appropriate measures;
  • prepares draft laws and secondary legislation as well as delivers opinions on draft laws during interdepartmental harmonisation procedure;
  • coordinates international and European cooperation in the areas of internal administrative affairs;
  • cooperates with foreign diplomatic and consular representative offices, national and international institutions;
  • participates in the work of EU and Council of Europe expert bodies;
  • coordinates and guides the work of organisational units responsible for internal administrative affairs within administrative units;
  • develops administrative information technology;
  • operates and develops registers of Slovenia and an information society and executes the tasks defined by the E–Administration strategy and action plan;
  • provides organisational, personnel, financial, administrative and technical support for the operation of the Directorate.

  

Migration and Integration

The Migration and Integration Directorate performs duties in the following areas:

  

  • monitors the situation in the field of migration, international protection and integration of refugees and foreigners, identifies trends and takes appropriate measures;
  • supervises the implementation of laws, regulations and general acts in the field of migration, international protection and integration of refugees and foreigners;
  • implements policies in the field of migration, international protection and integration of refugees and foreigners, puts forward initiatives and proposals for formulating and implementing migration policies in the Republic of Slovenia;
  • prepares draft laws and implementing regulations as well as opinions on draft laws in inter-departmental harmonisaton procedure;
  • prepares expert bases for and engages in international and European cooperation in the field of migration, international protection and integration of refugees and foreigners;
  • cooperates with diplomatic and consular representations of foreign countries and other domestic and international institutions;
  • coordinates the tasks of a working group responsible for ensuring unified and organised cooperation in the area of migration and for preparing measures to implement principles and goals of the migration policy, adopted on the basis of the Aliens Act and Resolution on the Migration Policy of the Republic of Slovenia;
  • participates in the work of EU and Council of Europe expert bodies;
    cooperates with international organisations operating in the area of migration, international protection and integration of refugees and foreigners (IOM, ICMPD, SE, UNHCR …);
  • coordinates and guides the work of organisational units responsible for internal administrative affairs at administrative units in the area of migration and integration;
  • provides organisational, personnel, financial, administrative and technical support for the operation of the Directorate and coordinates tasks in the field of information services with the Internal Administrative Affairs Directorate;
  • prepares analytical, statistical and descriptive information;
  • coordinates and performs activities of an intermediary body for the European Refugee Fund III and European Fund for the Integration of Third-Country Nationals.

 

 Guidance and oversight of the police

The Police and Security Directorate has the following responsibilities:

 

  • guiding and supervising the police;
  • preparing draft mandatory policies prescribed by the minister, and  preparing development, organisation, personnel and other basic policing guidelines in accordance with the existing rules;
  • preparing systemic solutions in various fields of policing;
  • preparing drafts of regulations and of other instruments and planning measures related to development, organisation, personnel and other basic policing guidelines, and preparing drafts of regulations on detective and private security activities and ski safety, which are proposed by the Ministry of the Interior;
  • receiving, handling and solving complaints filed against police officers’ work and the Police systemic and normative activities in drafting laws, implementing regulations and other police-related regulations;
  • conducting security vetting and issuing security clearances for access to classified information;
  • preparing systemic solutions and contingency plans for the operation of the Ministry, the Police and the Internal Affairs Inspectorate of the Republic of Slovenia in a crisis situation, state of emergency and war, and in the field of civil protection, rescue and assistance;
  • performing administrative tasks in the field of detective and private security activities and ski safety;
  • keeping the register of private security licence holders, the register of personnel employed by private security companies and the register of ski patrollers in ski areas;
  • cooperating with the Private Security Chamber and the Chamber of Detectives of the Republic of Slovenia on the development of detective and private security activities.
